And How It Affects Supplement Makers

Attention All California Clients

Proposition 65 is now in effect in California. The Attorney General of California has ordered that all products comply with Prop 65 by July 25, 2005.


All 600+ Nature's Sunshine Products now meet the standards of California Proposition 65 with the exception of the products listed below.


Please Note: Products will be added and taken off the list below while compliance testing is completed.

Our goal is to have all products comply with Prop 65 as soon as possible. Products that need to re-formulated will be re-formulated with concentrated extracts. This will not only bring the product into compliance, but it will make the product more potent and therefore more beneficial to our customers.


For those of you who have been angry with us, please understand, there is nothing we can do about this. The voters of California passed this proposition and it is now law. Believe us, we would much rather be selling you products that can help you rather than spending hundreds of thousands of dollars on testing and re-formulation.


We will attempt to keep this page up to date until all products comply.

What Is Proposition 65?

Proposition 65 was passed nearly 10 years ago by the voters in California and established California-only allowable levels of daily ingestion of four heavy metals:


Arsenic: 10 micrograms
Cadmium: 4.1 micrograms
Lead: 0.5 micrograms
Mercury: .3 micrograms


Strangely enough, the amounts above are less than what occurs naturally in numerous fruits, vegetables and water. The Proposition 65 standards are so tough that the following natural products are in violation of Prop 65:

Yams, turnips, apples, tomatoes, artichokes, carrots, cucumbers, green beans, lettuce, spinach, potatoes, corn and many, many more fruits and vegetables.


Example: Carrots contain 12.80 micrograms of arsenic in a one cup serving, higher than allowed under Prop 65. Green Beans contain 288.75 micrograms of lead in a one cup serving, 288 times the allowable limit!!

Even culinary water supplies violate Prop 65.


So, the California state legislature exempted culinary water, and fruits and vegetables grown in California, from this proposition.


Unfortunately herbal products were not exempted!!


Even though Prop 65 has not been universally enforced, Nature's Sunshine Products must be in compliance by July 25, 2005.


Because Prop 65 is not yet being universally enforced, it is possible for other manufacturers to sell substandard products in California. NSP assures you that if we sell a product in California it meets the highest standards of purity and potency.


To be in compliance with California Proposition 65, Nature's Sunshine Products had three choices:

1. Place warnings on all products that contain the above metals. The warning label to read:


A. WARNING: This product contains a substance known to the State of California to cause cancer.

B. WARNING: This product contains a substance known to the State of California to cause birth defects and other reproductive harm.


2. To discontinue selling any non-compliant products in the State of California.


3. To make non-compliant products comply.


NSP chose options 2 and 3. As part of the Nature's Sunshine dedication to quality, by replacing certain raw herbs with a concentrated, powdered extract of the same raw herb, we can reduce heave metals to almost imperceptible levels.


And, because powdered concentrated extracts are much more potent, this will not only increase the potency of the concentrated ingredient, it also increases the amount of the other ingredients in each formula, while maintaining the original herbal recipe and balance.


The result is a much more powerful product.
